Notice of Comprehensive Plan Map Amendment

Notice is hereby given that the City of West Melbourne, Brevard County, Florida, has called for Public Hearing(s) to be held as follows:

West Melbourne Planning & Zoning Board, September 8, 2020 at 6:30 p.m., or as soon thereafter as the matter may be heard in the Council Chamber located at 2285 Minton Road, West Melbourne, Florida. The Planning & Zoning Board will take public comment and make a recommendation to the City Council on whether to transmit the proposed Comprehensive Plan Amendment No. 2020-01 (LSA) map amendment and rezone the property to City of West Melbourne Gateway Interchange District (GTWY-I).

West Melbourne City Council, September 24, 2020, at 6:30 p.m., or as soon thereafter as the matter may be heard in the Council Chamber located at 2285 Minton Road, West Melbourne, Florida.  The City Council will take public comment, the Planning and Zoning Board’s recommendation and consider whether to transmit the proposed Comprehensive Plan Amendment No. 2020-01 (LSA) map amendment and rezone the property to City of West Melbourne Gateway Interchange District (GTWY-I).

Comprehensive Plan Amendment No. 2020-01 (LSA) map amendment proposes to amend the City’s future land use map to designate Parkway Interchange use for property consisting of 59.61 acres, more or less. The property is located on the north side of U.S. 192 at the terminus of Columbia Lane and west of Interstate 95 and as indicated on the map of this advertisement. The property is more particularly described as follows:

A parcel of land in Section 34, Township 27 South, Range 36 East, Brevard County, Florida being more particularly described as follows: Commence at the north quarter section corner of said Section 34, and run 89°26’29”E, along the north line of said Section 34, a distance of 1950.89 feet to the west right-of-way line of Interstate Highway No. 95; thence S00°01’54”E, along said west right-of-way line, a distance of 331.11 feet to the point of beginning of the parcel of land herein described; thence continue S00°01’54”E, along said west right-of-way line, a distance of 1510.23 feet; thence continue S00°01’54”E, along said west right-of-way line, a distance of 371.40 feet; thence N90°00’00”W a distance of 1736.42 feet to the east right-of-way line of the proposed St Johns Heritage parkway according to the construction plans for Brevard County, Florida Financial Project Number 428346-4-54-01, Dated August, 2016; thence N00°06’47”W, along said proposed east right-of-way line, a disCPLSA_ REZ Heritage Lakestance of 563.29 feet to the beginning of a curve to the right; thence continuing along said proposed east right-of-way line and along the arc of said curve, (said curve being curved concave to the southeast and having a radius of 1327.00 feet, a central angle of 47°48’06”, a chord bearing of N23°47’16”E and a chord length of 1075.28 feet), a distance of 1107.11 feet to an intersection with a non-tangent line to the south; thence S42°19’19”E, along said non-tangent line, a distance of 75.22 feet; thence N90°00’00”E a distance of 949.50 feet; thence N00°02’46”W a distance of 347.29 feet; thence N81°58’15”E a distance of 305.92 feet to the point of beginning. Containing 59.61 acres, more or less.

Subject to the following easements and agreements:

That certain 50 foot wide Florida Gas Transmission Company Easement recorded in Official Records Book 998, Page 279; that certain 60 foot wide Florida Power & Light Company right-of-way agreement recorded in Official Records Book 53, Page 565; that certain 30 foot wide Florida Gas Transmission company easement recorded in Official Records Book 526, Page 9; and that certain storm sewer and maintenance road easement recorded in Official Records Book 5663, Page 7542. All in the Public Records of Brevard County, Florida.

The public hearing(s) may be continued to a time and date certain by announcement at the scheduled hearing without any further published notice. 

A copy of the proposed comprehensive plan amendment is available for public inspection at City Hall, 2240 Minton Road, West Melbourne, Florida. All persons wishing to be heard should appear in person at these hearings or send written comments to the City Clerk.  All persons and parties are hereby advised that if they should decide to appeal any decision made by the City with respect to any matter considered at the public meeting or hearing described in this notice, they will need a record of the proceedings, and for such purpose, said person or party may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (Chapter 286, Florida Statutes).  In compliance with the Americans with Disabilities Act (ADA), anyone who needs a special accommodation for this meeting should contact the City Clerk at (321) 837-7774 at least 24 hours in advance of this meeting.
