 Notice of Comprehensive Plan Map Amendment

Notice is hereby given that the City of West Melbourne, Brevard County, Florida, has called for Public Hearing(s) to be held as follows: 

West Melbourne Planning & Zoning Board, January 12, 2021 at 6:30 p.m., or as soon thereafter as the matter may be heard in the Council Chamber located at 2285 Minton Road, West Melbourne, Florida. The Planning & Zoning Board will take public comment and make a recommendation to the City Council on whether to transmit the proposed Comprehensive Plan Amendment No. 2021-01 (LSA) map amendment and rezone the properties to City of West Melbourne Commercial Parkway (C-P) and Light Industrial and Warehousing (M-1).

West Melbourne City Council, January 19, 2021, at 6:30 p.m., or as soon thereafter as the matter may be heard in the Council Chamber located at 2285 Minton Road, West Melbourne, Florida.  The City Council will take public comment, the Planning and Zoning Board’s recommendation and consider whether to transmit the proposed Comprehensive Plan Amendment No. 2021-01 (LSA) map amendment and rezone the properties to City of West Melbourne Commercial Parkway (C-P) and Light Industrial and Warehousing (M-1).

Comprehensive Plan Amendment No. 2021-01 (LSA) map amendment proposes to amend the City’s future land use map to designate Commercial use for property consisting of 16.89 acres, more or less and Industrial use for property consisting of 17.63 acres, more or less. The properties are located on the north side of U.S. 192, west of Interstate 95, and east of St Johns Heritage Parkway and as indicated on the map of this advertisement. The property is more particularly described as follows: 

Parcel Identification Number 28-36-03-00-4 by the Property Appraiser of Brevard County – 17.63 acres, more or less:

LOT 29, FLORIDA INDIAN RIVER LAND COMPANY SUBDIVISION, SECTION 3, TOWNSHIP 28 SOUTH, RANGE 36 EAST, AS RECORDED IN PLAT BOOK 2, PAGE 80 OF THE PUBLIC RECORDS OF BREVARD COUNTY, FLORIDA. TOGETHER WITH THE NORTH 25.00 FEET OF A PORTION OF LOT 19, FLORIDA INDIAN RIVER LAND COMPANY SUBDIVISION, SECTION 3, TOWNSHIP 28 SOUTH, RANGE 36 EAST, AS RECORDED IN PLAT BOOK 2, PAGE 80 OF THE PUBLIC RECORDS OF BREVARD COUNTY, FLORIDA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:  

COMMENCE AT THE NORTHWEST CORNER OF SAID LOT 19 AND RUN N89°31’01”E ALONG THE NORTH LINE OF SAID LOT 19 A DISTANCE OF 316.24 FEET TO THE WESTERLY RIGHT OF WAY OF COLUMBIA LANE (AN 80 FOOT RIGHT OF WAY); THENCE S00°02’55”E ALONG SAID WEST RIGHT OF WAY A DISTANCE OF 25.00 FEET; THENCE S89°31’01”W A DISTANCE OF 316.24 FEET TO THE WEST LINE OF SAID LOT 19; THENCE N00°10’40”W ALONG THE WEST LINE OF LOT 19,  25.00 FEET TO THE POINT OF BEGINNING; TOGETHER WITH AN EASEMENT FOR INGRESS/EGRESS BEING THE NORTH 50.00 FEET OF EAST 50.00 FEET OF LOT 20, FLORIDA INDIAN RIVER LAND COMPANY SUBDIVISION, SECTION 3, TOWNSHIP 28 SOUTH, RANGE 36 EAST, AS RECORDED IN PLAT BOOK 2, PAGE 80 OF THE PUBLIC RECORDS OF BREVARD COUNTY, FLORIDA, AND ALSO BEING SUBJECT TO A 25 FOOT DRAINAGE EASEMENT OVER THE WEST 25 FEET OF LOT 29 AND ALSO BEING SUBJECT TO AN EASEMENT FOR INGRESS AND EGRESS OVER THE SOUTH 25 FEET OF THE EAST 100 FEET OF SAID LOT 29.

The public hearing(s) may be continued to a time and date certain by announcement at the scheduled hearing without any further published notice.  A copy of the proposed comprehensive plan amendment is available for public inspection at City Hall, 2240 Minton Road, West Melbourne, Florida. All persons wishing to be heard should appear in person at these hearings or send written comments to the City Clerk.  All persons and parties are hereby advised that if they should decide to appeal any decision made by the City with respect to any matter considered at the public meeting or hearing described in this notice, they will need a record of the proceedings, and for such purpose, said person or party may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (Chapter 286, Florida Statutes).  In compliance with the Americans with Disabilities Act (ADA), anyone who needs a special accommodation for this meeting should contact the City Clerk at (321) 837-7774 at least 24 hours in advance of this meeting.
